KEY POINTS
- Any Government Code Claim that relates to a cause of action for death or injury to a person or to personal property or growing crops shall be presented no later than 6 months after the accrual of the cause of action.
- If the board fails or refuses to act on a claim within the time prescribed, the claim shall be deemed rejected by the board. If the claim is denied by the board, the claimant has 6 months to file a lawsuit. However, if the claim is "deemed denied" then the claimant has 2 years to file a lawsuit from the accrual of the cause of action.
- All claims other than for personal injury, injury to property, or growing crops, shall be presented no later than one year after the accrual of the cause of action.
- The Government Code Claim must include a general description of the indebtedness, obligation, injury, damage or loss incurred so far as it may be known at the time of presentation of the claim.
- If the amount being claimed in total is less than $10,000, then the claim must identify the amount in the claim. However, if the claim is over $10,000, no dollar amount is required to be included in the claim.
