KEY POINTS
- The CSLB's citation fees range from several hundred dollars for not having your license number on company vehicles all the way up to several thousands to several tens of thousands for contracting with an unlicensed contractor.
- A licensee’s failure to comply with a CSLB issued citation can result in the immediate suspension or revocation of their contractor’s license. The failure of an unlicensed person or entity to comply with a final citation is a misdemeanor.
- A consumer complaint may be referred to arbitration so long as it follows the criteria required. Arbitration is an opportunity presented by the CSLB for both parties to have an arbitrator hear and rule on a dispute between a claimant and a contractor. If a case goes to arbitration, the licensee may still be cited by the CSLB depending on the violations of the dispute.
- If you’ve been issued a citation from the CSLB, you have 15 business days to appeal the citation with the Registrar of Contractors pursuant to Business and Professions Code section 7099.3 unless exempt. These 15 days may be extended but only for a legitimate cause deemed by the registrar. If deciding to contest the citation you will be provided a hearing date, after that the Registrar will issue a decision based on the findings.
- The CSLB will use the citation and arbitration procedures for violations that can be corrected for the benefit of the licensee’s customer, the CSLB will use the accusation procedure when the primary purpose is to impose discipline such as license suspension or revocation.
